一、五(wu)险(xian)一金包括什(shen)么
“五险(xian)(xian)”指的是(shi)五种保(bao)(bao)(bao)险(xian)(xian),包括(kuo)养老保(bao)(bao)(bao)险(xian)(xian)、医疗保(bao)(bao)(bao)险(xian)(xian)、失业保(bao)(bao)(bao)险(xian)(xian)、工(gong)伤保(bao)(bao)(bao)险(xian)(xian)和(he)生育保(bao)(bao)(bao)险(xian)(xian);“一金”指的是(shi)住房(fang)公积金。
由上可知,五险一金包括(kuo)社保(bao)与公积金两个部分。
二、劳务(wu)派遣工有(you)社保吗?
根(gen)据《劳动派(pai)遣(qian)暂行规定》,按照国家规定和派(pai)遣(qian)协议(yi)约定,依法(fa)为被(bei)派(pai)遣(qian)劳动者(zhe)缴纳社会(hui)保险(xian)(xian)费,并办理社会(hui)保险(xian)(xian)相关手(shou)续。
派(pai)遣(qian)(qian)单(dan)(dan)位(wei)(wei)跨地区派(pai)遣(qian)(qian)劳动(dong)者的,应当在(zai)用(yong)(yong)工单(dan)(dan)位(wei)(wei)所在(zai)地为劳务派(pai)遣(qian)(qian)工参(can)加社(she)会(hui)保(bao)(bao)险(xian)(xian),按照用(yong)(yong)工单(dan)(dan)位(wei)(wei)所在(zai)地的规定(ding)缴纳社(she)会(hui)保(bao)(bao)险(xian)(xian)费,被派(pai)遣(qian)(qian)劳动(dong)者按照国家规定(ding)享(xiang)受社(she)会(hui)保(bao)(bao)险(xian)(xian)待遇。
劳动派遣(qian)单(dan)位在(zai)用工单(dan)位所(suo)在(zai)地设立(li)分支(zhi)机构的,由分支(zhi)机构为被派遣(qian)劳动者(zhe)办理参保手续,缴(jiao)纳(na)社会保险(xian)费。
劳(lao)动派遣单位(wei)(wei)未在(zai)用工单位(wei)(wei)所在(zai)地(di)设立分支机构(gou)的,由用工单位(wei)(wei)代劳(lao)务派遣单位(wei)(wei)为被派遣劳(lao)动者办理参保手续,缴纳社会(hui)保险费。
三、劳(lao)务派遣工有(you)公(gong)积金吗?
根据(ju)我(wo)国(guo)《劳动(dong)(dong)合同法(fa)》第58条的(de)(de)规定,劳动(dong)(dong)派(pai)遣(qian)单(dan)位(wei)(wei)(wei)是劳动(dong)(dong)法(fa)上的(de)(de)用(yong)人单(dan)位(wei)(wei)(wei),应当履行用(yong)人单(dan)位(wei)(wei)(wei)对劳动(dong)(dong)者(zhe)的(de)(de)义务。劳动(dong)(dong)派(pai)遣(qian)单(dan)位(wei)(wei)(wei)与被派(pai)遣(qian)劳动(dong)(dong)者(zhe)订立劳动(dong)(dong)合同。因此,作(zuo)为用(yong)人单(dan)位(wei)(wei)(wei)的(de)(de)劳务劳务应当为劳动(dong)(dong)者(zhe)缴交住(zhu)房(fang)公积金。至于这(zhei)笔经费的(de)(de)最终来源,应由派(pai)遣(qian)单(dan)位(wei)(wei)(wei)和(he)实际用(yong)工(gong)单(dan)位(wei)(wei)(wei)以(yi)协(xie)(xie)议(yi)形式明确。《劳动(dong)(dong)合同法(fa)》第59条规定,派(pai)遣(qian)单(dan)位(wei)(wei)(wei)派(pai)遣(qian)劳动(dong)(dong)者(zhe)应当与接受以(yi)派(pai)遣(qian)形式用(yong)工(gong)的(de)(de)单(dan)位(wei)(wei)(wei)订立劳动(dong)(dong)派(pai)遣(qian)协(xie)(xie)议(yi)。劳动(dong)(dong)派(pai)遣(qian)协(xie)(xie)议(yi)应当约定派(pai)遣(qian)岗位(wei)(wei)(wei)和(he)劳务派(pai)遣(qian)工(gong)数量、派(pai)遣(qian)期限、劳动(dong)(dong)报酬和(he)社会保险费的(de)(de)数额与支(zhi)付方式以(yi)及违反(fan)协(xie)(xie)议(yi)的(de)(de)责(ze)任。
